REVIEW TERMS BEFORE BOOKING.

1. Acceptance of These Terms

By using this website, the instant estimate tool, the estimate request form, the signup form, or any other Hyggeworx website form, you agree to these Terms of Service. If you do not agree, do not use the website forms or rely on website estimate information.

2. Services Covered

These Terms may apply to quote requests, communications, scheduling, website intake, and related business activity for services including forestry mulching, brush clearing, land clearing, property reclamation, trail cutting, view clearing, food plot preparation, access clearing, commercial mowing, residential mowing, roadside, field, lot, and rough-area mowing, storm cleanup, stump work, excavation, grading, drainage, driveways, pads, culverts, gravel work, snow removal, ice management, recurring property maintenance, vegetation treatment, hauling or disposal if expressly listed, and other equipment-based land or property services Hyggeworx agrees to quote or perform.

Not all services are available in all seasons, locations, or site conditions. Some services may require site review, a written estimate, subcontractor coordination, equipment availability, weather windows, permits, or a separate written scope.

3. Website Estimates Are Preliminary Only

Online estimates, instant pricing outputs, calculator results, preliminary ranges, website submissions, and estimate requests are not final quotes and are not binding contracts. They are preliminary planning tools only.

A website estimate is not a final quote and is not a binding contract.

A final quote, work authorization, or contract exists only when accepted in writing by Hyggeworx and, where required, signed or otherwise approved by the owner or authorized representative.

4. No Contract Until Written Acceptance

Submitting a website form does not create a contract, authorize work, reserve equipment, guarantee scheduling, guarantee pricing, require Hyggeworx to accept the project, or authorize entry onto the property.

Final pricing and work authorization require written approval, a written estimate, a work authorization, or a signed agreement where applicable. Work may begin only after the necessary written scope, scheduling approval, and owner authorization are in place.

5. User Authority and Accuracy

By submitting property, contact, project, or estimate information, you represent that you are the property owner or an authorized representative of the property owner. You also represent that the information you submit is accurate and complete to the best of your knowledge.

6. Scope Limits

Standard mulching and clearing generally leaves processed material in place unless a written estimate or work authorization says otherwise.

Unless separately listed in a written estimate or work authorization, the scope does not include piling, finish grading, hauling, dumping, disposal, vegetation treatment, excavation, stump extraction below grade, surveying, utility locating, permitting, environmental review, erosion control, restoration, or other work outside the written scope.

7. Pricing, Adjustments, and Change Approval

Website prices and preliminary ranges depend on submitted conditions and may change based on access, terrain, wet or rocky soil, brush density, hidden conditions, safety concerns, weather, equipment needs, fuel, and owner-requested changes.

Unless otherwise stated in writing, written estimates or quotes are valid for 30 days. Online instant estimates are preliminary and do not create a 30-day binding price lock unless confirmed in writing by Hyggeworx.

Added work or added charges require owner approval. Hyggeworx will not treat an online estimate as approval for extra work or extra charges.

8. Deposits, Payment Methods, and Fees

A 50% deposit may be required to schedule work, reserve equipment, or hold calendar time unless waived or modified in writing. Deposits are credited toward the final invoice.

Deposits may be non-refundable if the customer cancels, delays, denies access, fails to disclose material conditions, fails to obtain permissions or permits, or prevents performance after scheduling, subject to the written estimate or agreement. The written estimate or agreement controls.

Accepted payment methods may include cash, check, money order, Visa, Mastercard, American Express, Cash App, and PayPal. Credit card payments are subject to a pass-through processing fee of 4%. PayPal or other third-party payment services may carry their own pass-through fees.

Cash is preferred where lawful and practical, and customers may ask whether a cash discount is available. Written receipts are provided for all cash payments. Payment terms in a written estimate, invoice, or contract control.

9. Late Payment and Collections

Payment is due as stated in the written estimate, invoice, or agreement. Unpaid balances may result in collection action, legal action, recovery of fees and costs where permitted by law, or suspension of further work.

10. Site Risk and Safety

Forestry mulching, land-clearing, excavation, snow work, and other equipment-based services carry inherent risks. Equipment-based work can throw debris, disturb soil, create rutting, affect vegetation, contact hidden objects, and carry risk near structures, fences, vehicles, utilities, landscaping, improvements, and personal property.

Hyggeworx is not responsible for damage, delay, or cost caused by undisclosed, hidden, buried, misidentified, or restricted conditions.

11. Owner Responsibilities

The owner is responsible for confirming authority, providing accurate site information, and identifying boundaries, access routes, utilities, septic systems, wells, water lines, buried wires, drainage, wetlands, protected areas, easements, hazards, restricted areas, neighbor or boundary issues, structures, fences, improvements, and personal property to protect or remove.

The owner must keep people, pets, livestock, vehicles, equipment, and personal property outside active work zones.

12. Utilities, Permits, and Environmental Restrictions

Hyggeworx is not a surveyor, utility locator, engineer, forester, environmental consultant, wetland specialist, permitting authority, or regulator.

The customer is responsible for confirming the requested work is lawful and for obtaining any required permits, notices, approvals, HOA permissions, shoreland or wetland approvals, environmental approvals, erosion-control approvals, or land-use permissions unless a written agreement states otherwise.

13. No Guarantee of Results

Hyggeworx does not guarantee acreage coverage, finish quality, aesthetic result, soil condition, view quality, vegetation suppression, regrowth prevention, drainage improvement, trail finish, future usability, erosion control, snow or ice outcome, or long-term land condition unless expressly stated in a signed written agreement.

14. Photos, Video, Maps, and Documentation

Submitted photos, maps, site descriptions, and related information may be used to evaluate, document, quote, schedule, perform, defend, and manage requested work.

Hyggeworx may document sites before, during, and after work using photos, video, maps, body camera, drone, or other documentation for safety, insurance, business records, training, proof of condition, claim prevention, and dispute resolution.

Marketing use is limited to non-identifiable use unless the customer consents or does not object where legally appropriate.

15. Website Communications and Email

Submitting a form permits Hyggeworx to contact you by email, phone, text, or another method you provide. Email delivery is not guaranteed, and you should check spam or junk folders.

A confirmation email means your submission was received or processed by the website system. It does not mean the project is accepted, scheduled, approved, or authorized.

16. SMS / Text Messaging Terms

By checking an SMS consent box or otherwise opting into text messages, you agree to receive texts from Hyggeworx. Messages may include estimate follow-ups, appointment confirmations, scheduling notices, project updates, service reminders, customer support messages, educational content, seasonal reminders, offers, and promotions.

Message frequency varies. Message and data rates may apply. Consent to marketing texts is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

You may opt out by replying STOP if supported, or by contacting Hyggeworx directly. You may request help by replying HELP if supported, or by calling or emailing Hyggeworx. Please notify Hyggeworx if you change or transfer your phone number.

Hyggeworx may change or terminate messaging programs and may update messaging terms. Continued enrollment after changes means acceptance of the updated messaging terms. Privacy or data questions should refer to the Hyggeworx privacy policy if and when published, or contact Hyggeworx directly.

17. Online Forms, Signups, and Submission Logs

Hyggeworx may log website form submissions, estimate requests, instant pricing requests, update signups, technical source information, SMS consent records, and related payloads for business, quoting, compliance, and recordkeeping.

Do not submit sensitive personal information, payment card numbers, health information, passwords, private legal documents, or confidential third-party information through website forms.

18. Prohibited Use

You may not use the website for false submissions, unauthorized property requests, form abuse, scraping, injection attempts, malicious activity, automation that burdens the site, competitive misuse, harassment, unlawful use, or interference with website operation.

19. Intellectual Property

Website materials, text, images, estimate logic, calculators, forms, branding, design, service descriptions, and related content belong to Hyggeworx or are used with permission. You may not copy or reuse them except as allowed by law or with written permission.

20. Third-Party Services

Hyggeworx is not responsible for third-party links, hosting services, maps, embedded media, plugins, email providers, carrier delivery, external service interruptions, or the content and practices of other websites.

21. Disclaimers

The website and estimate tools are provided as-is and as-available. Hyggeworx makes no warranty that website operation will be uninterrupted, error-free, secure, accurate, current, or suitable for your particular property or purpose.

22. Limitation of Liability

To the fullest extent allowed by law, Hyggeworx is not liable for indirect, incidental, consequential, special, exemplary, punitive, or loss-of-use damages arising from website use, form errors, estimate calculations, delays, email failures, technical failures, user-submitted inaccuracies, or reliance on preliminary online pricing.

23. Indemnification

You agree to hold Hyggeworx harmless from claims arising from inaccurate submissions, lack of authority, undisclosed site conditions, boundary disputes, permitting issues, third-party claims, unlawful requests, or breach of these Terms.

24. No Waiver of Non-Waivable Rights

Nothing in these Terms waives rights or obligations that cannot legally be waived. If any part of these Terms is unenforceable, the remaining parts continue to apply to the fullest extent allowed by law.

25. Relationship to Written Agreements

If you later sign or accept a written estimate, work authorization, contract, or change order, that written document controls over these website Terms if there is a conflict.

26. Changes to Terms

Hyggeworx may update these Terms from time to time. The posted version controls website use after it is published.
